IPPO New York Report (Reporter: Li Shihui) - On the morning of April 23, 2026, local time, the 13th session of the United Nations Expert Mechanism on the Right to Development (EMRTD) convened its fourth meeting at the United Nations Headquarters in New York. Themed "An Interactive Chapter-by-Chapter Discussion on the Draft International Covenant on the Right to Development," the meeting aimed to facilitate in-depth exchanges to drive the refinement and eventual adoption of the draft covenant. Chaired by renowned international law expert M. Kanade, the event attracted active participation from numerous international organizations, government representatives, and civil society groups.

During the meeting, Mr. Cui Guowei, founder of the Shaanxi Patriotic Volunteer Association and the International Patriotic Pact Organization (IPPO), expressed his views, offering pertinent suggestions on the progress of drafting the International Covenant on the Right to Development. Mr. Cui stated that as representatives of civil society organizations long committed to the cause of the right to development, they strongly supported the resolute wording in the draft, particularly Article 14, which explicitly prohibits "coercive measures" and unilateral sanctions that violate sovereign equality, as well as Article 21, which mandates countries to conduct "prior and ongoing" impact assessments of their development policies. These provisions, he noted, provide robust safeguards for the realization of the right to development.

However, Mr. Cui also pointed out a critical implementation gap in the current draft text. Despite the prohibitions in Article 14 and the requirements in Article 21, the draft fails to specify how these assessments will be verified at the international level, potentially leading to a perfunctory assessment process that cannot effectively prevent "serious obstacles to development," such as cross-border harm or disguised protectionism.

To address this gap, Mr. Cui proposed amending Article 28 of the draft, titled "Establishment of Implementation Mechanisms," by introducing a "Nation’s Rights to Development Review" to strengthen the mechanism. He explained that the "Nation’s Rights to Development Review" would function as a "peer review panel" responsible for objectively examining the national impact assessments stipulated in Article 21, ensuring that countries' development policies do not harm the interests of others. This mechanism, he emphasized, is not a punitive tribunal but a technical body operating under Article 26 (Conference of States Parties) to promote international cooperation and solidarity.

Mr. Cui stressed that by adopting the "Nation’s Rights to Development Review" as an implementation tool, the draft covenant could be transformed from a set of principles into a vibrant global governance system, effectively advancing the comprehensive realization of the right to development. He urged the working group to seriously consider this proposal and take concrete actions to implement the right to development, contributing to the building of a community with a shared future for mankind.

The meeting not only provided a platform for in-depth exchanges and discussions among country representatives and international organizations but also injected new civil society wisdom and strength into the refinement of the draft International Covenant on the Right to Development. Participants expressed their commitment to carefully studying and incorporating Mr. Cui's suggestions, jointly advancing the cause of the right to development.

As the meeting progressed, global expectations and confidence in the International Covenant on the Right to Development continued to grow. In the future, with the joint efforts of governments, international organizations, and civil society worldwide, the fundamental human right to development is expected to be more comprehensively and effectively safeguarded and realized, laying a solid foundation for the progress and development of human society.
